She contends that welfare, social justice, and citizenship are interconnected and discusses this relationship in the context of EU welfare law, describing its origins and purpose and showing that equal treatment on the grounds of nationality has been constructed as secondary to the higher objectives of the market, then addresses the limitations of EU citizenship and the issue of tolerated direct discrimination on the grounds of nationality in domestic welfare regimes; the consequences of the shift away from proportionality to mitigate problems with equal treatment and the groups at a greater disadvantage due to the shift; and the ideological aspects of market citizenship, focusing on the concepts of responsibility and fairness in an agenda emphasizing economically “active” citizens, and considering the capitalist construction of equal treatment rights on the grounds of sex and disability to show how fundamental rights and conceptions of equality are framed around the market ideal of activation. She discusses the activation-plus regime imposed on EU nationals in the UK, in which only economically active EU nationals have any entitlement, and how the reforms consist of declaratory discrimination and create obstacles to movement; the problems with the social security regulation legislation; administrative obstacles to EU citizens’ rights and justice; and how social justice can be possible.
